Bernanke Fed action hints boost US stocks

Ben Bernanke's much-awaited endorsement of more Federal Reserve stimulus Friday gave stocks a solid boost, though tempered by his picture of an economy that remains weak and vulnerable.

The Dow Jones Industrial Average added 90.13 points (0.69 percent), closing at 13,090.84.

The broad-based S&P 500 rose 7.10 (0.51 percent) to 1,406.58, while the tech-rich Nasdaq climbed 18.25 (0.60 percent) to 3,066.96.

In his speech at a central bankers summit in Jackson Hole, Wyoming, Fed Chairman Bernanke warned that stagnation in the US labor market was "a grave concern" and signaled he would be pushing for more help for the sluggish economy when the Fed's policy board meets in 12 days.

"Chairman Bernanke's comments should be taken positively as he indicated a willingness to increase support to the economy," said Michael James, an analyst at Wedbush Morgan Securities.

James said that a third round of Fed quantitative easing, dubbed QE3, was "more likely than unlikely, based on my reading of his commentary today, and that will continue to be positive for market sentiment next week."

On the economic front, factory orders jumped 2.8 percent in July, the best gain in a year, the Commerce Department said.

Rumors swirled that Japan's Sharp had fallen behind on production of screens for Apple's latest iPhone, expected to be launched in September. Apple rose 0.2 percent.

"The delay in Sharp's delivery raises questions about whether Apple can secure enough iPhone screens to meet the strong demand expected for the new model," said 24/7WallSt.com analysts.

Ahead of a long holiday weekend, there was little company news. All US markets are closed Monday for Labor Day.

Government services contractor SAIC jumped 3.4 percent after reporting second-quarter revenue that topped estimates and announcing it would split into two publicly traded companies.

Bonds rallied. The yield on the 10-year Treasury fell to 1.56 percent from 1.62 percent Thursday, while the 30-year yield dropped to 2.68 percent from 2.74 percent. Bond yields move inversely to prices.

France offers to pick up tab for young hires

(AP) ? The French government wants companies to hire young people so much that it's offering to pick up the tab.

The new Socialist president, Francois Hollande, told his Cabinet Wednesday that he wants to wage a war on unemployment and unveiled a plan for the government to pay most of the salaries of tens of thousands of young people hired next year.

Unemployment in France is 10 percent, but nearly 23 percent for those under the age of 25. That's an imbalance that many European countries are struggling with: In Spain, youth unemployment is over 52 percent; it's 34 percent in Italy.

European employers are especially reluctant to hire young people because restrictive labor laws make it hard for companies to lay off employees. What's more, in France, young people are typically required to do a series of often unpaid internships before landing a full-time job or can only manage to get short-term contracts for years on end.

But few countries are approaching the problem in the way that France is. Italy and Spain have proposed modest tax breaks for companies that hire people just entering the workforce but have focused more on fundamental reforms of the labor market that they hope will address the root causes.

Under France's new plan, companies that hire a person between 16 and 25 for at least a year will only have to pay as little as 25 percent of the salary. The government hopes to create 100,000 of these "contracts for the future" next year and another 50,000 in 2014. It has promised to continue paying its share of the employee's salary for three years.

The government will give preference to young people hired from poor urban or rural areas that have been hit hardest by rising unemployment. Certain sectors will also be favored, such as medicine and digital or green technology.

"We are waging a battle for jobs," Hollande told Cabinet ministers, according to government spokeswoman Najat Vallaud-Belkacem. "It's the No. 1 challenge of our mandate."

Some economists were skeptical of the approach.

"Making the structures of the economy more competitive and better performing is what really has to drive the thinking (in countries such as Spain, Italy and Greece)," said Nicolas Veron, an economist affiliated with the Brussels-based think tank Bruegel and the Peterson Institute in Washington. "It's not about targeted programs; it's about the structure of the (labor) market."

Whereas countries like Spain and Italy have recently passed wide-ranging labor market reforms to regain waning investor confidence in their economies, France has so far been able to put off those kinds of tough decisions. Investor confidence in France has remained relatively strong in part because of the sheer size of the economy ? it is the eurozone's second-largest ? and also the fact that its neighbors are worse off. But experts warn France will eventually also have to face the need to reform its economy.

The proposal needs to make its way through Parliament, but Hollande's Socialist Party has a solid majority there and the issue was a major campaign promise.

Hollande has staked his credibility on driving down unemployment and encouraging growth, all while meeting strict budget deficit targets. It's unclear whether he can manage all three ? especially since the economy's fate is largely tied up with Europe's wider debt crisis and the well-being of its neighbors.

An entrepreneur's association immediately panned the idea.

"The jobs for the future are only a Band-Aid, if a necessary Band-Aid, in the face of a government that every day shows itself more incapable of overcoming the difficulties our country is confronted with," said Guillaume Cairou, president of the Club of Entrepreneurs and CEO of strategy consultancy DIDAXIS. "How can they not see that this cost is extremely high for the government, even while we should be reducing our deficit?"

The government estimates that the program will cost ?2.3 billion ($2.9 billion) next year; it did not detail costs for the following years.

The Impacts of Inconsistent Pet Restrictions on Base : StubbyDog

The U.S. military forces are among the bravest and most selfless people in our country. They dedicate and risk their lives to protect our citizens and rights. While serving in the military, it?s common to be transferred to varying locations both within the U.S. as well as internationally. Moving is stressful and uprooting your entire life over and over again is difficult. To make matters worse, pet rules vary from one location to the next, limiting how many pets are allowed and prohibiting select breeds and types of dogs. Risking life and comfort for our country is part of military service. For all that our service men and women do for our country, to deny them the familiarity and love of their own pets is not acceptable. Pets are family and should be able to provide comfort and affection to their loving owners no matter where life and military service may take them.

Here, and in many other stories on our site, we share the stories of many military families have been impacted by the inconsistent pet restrictions currently in place:

?I moved off base just to keep my baby. I followed the base?s ?grandfather-in? rule to keep my Staffordshire Bull Terrier on base. This only bought us an extra year and a half, and then they were going to kick us out if I did not give up my dog. No thanks. I will live off base.? ? Erica

?My husband is active duty Navy E4 and has been in for two years. We are currently at New London sub base in Groton, Conn. We now live in base housing here, and they did not have an issue with Cody, our dog. I don?t get why one base would have an issue and the other wouldn?t. ?I have a Boxer/Lab mix, but the base said he looked like a pit bull, and we were told we had to get our dog?s blood checked to show that he wasn?t a pit bull because they wouldn?t take the veterinarian?s word to be enough. In the meantime, our house was on hold for us, and we signed all the leasing documents and everything. The blood test came back, and our dog was less than 3 percent pit bull, but because he was some part pit bull, we couldn?t keep him and had to sign other papers saying we wouldn?t have him on base. I spent over $500 flying him to California to live with my parents, and then after it was done we went in to get our keys and show them that our dog was now in California. They had given our house away to someone else after we signed a leasing agreement, and they said they didn?t think that we would give up our dog. We had nowhere else to go, and the apartment we were staying in was going up in price, and we couldn?t afford it. They finally found us a house, and it wasn?t fully ready for new move-in condition, but we needed a house by that weekend. So we moved in and got a bad location and stained carpet because they didn?t have time to fix it. I lost my best dog and got a bad place to live. It?s stupid how they choose what dogs can stay. I?ve been bitten twice by the Chihuahua next door, but that?s OK because it?s small.? ? Jessica

?I have a gorgeous pit bull named Willie that a devastated soldier brought to our shelter. He had to give him up due to breed-discriminatory legislation at the base he is transferring to. We ended up having to give one of our cats to my aunt and uncle before we left. I?m so glad that they were able to take him because I know that he is happy, loved and safe. ?We adopted an amazing Rottweiler in Virginia seven years ago and had no problems in either Virginia or Connecticut, but when were about to move to Florida we found that she was not allowed in housing (even though the same parent company managed both the Connecticut and Florida housing communities). Being as we have special needs children, I was able to get special paperwork together to have her here as an ESA (Emotional Support Animal), but it took over six months to complete, and thankfully during this time my sister in Massachusetts was able to foster her. I agree that policies need to be standardized across the board. Honestly, I am more scared of my neighbors little yippy dog than I am of my Rottie.? ? (AP) ? You wouldn't know it from listening to the Republican National Convention, but the nation's economic picture seems to be slowly getting a little brighter.

Not a lot, and not very fast. Yet there are some glimmers.

But a steady drumbeat of gloom and doom is predictably being sounded at the GOP gathering in Tampa, Fla. ? even by Republican governors who are quick to tout economic improvements in their own states.

Nationally, the recent gains are modest and won't do much to push the unemployment rate down much below its present 8.3 percent level before the Nov. 6 presidential election.

But economists cite some encouraging new data:

? The government reported Thursday that Americans spent at the fastest pace in five months in July, and personal income rose as well.

? Home prices rose in the first half of 2012 for the first time in nearly two years. Sales of both new and previously occupied homes also are up.

? Employers added 163,000 jobs in July, the most since February.

? U.S. exports, retail spending and factory production are all up.

Yet phrases such as "catastrophic debt," ''stifling the American dream," ''the tide of decline" and "an all-out assault on free enterprise" fill the air in the convention arena.

The rhetoric fits the GOP strategy of portraying President Barack Obama as out of touch and pursuing policies that have made the economy worse, not better, while Republican presidential nominee Mitt Romney is presented as the one with the business experience and savvy to turn things around.

Of course, Democrats get their turn for rebuttal next week at their own convention in Charlotte, N.C. But there are risks to sounding too optimistic on the economy.

Obama has been relatively cautious ? welcoming recent positive reports but warning there's still a long road to a full recovery. To be more upbeat might play into GOP efforts to cast him as insensitive to the millions of Americans who remain jobless or are otherwise economically challenged.

Also, on Sept. 7, the morning after Obama accepts the Democratic nomination for a second term, the government releases unemployment figures for August. No one expects stellar figures.

Indeed, the economic recovery in the U.S. is the weakest of any since the Great Depression. Economic growth has never been feebler in a postwar recovery, consumer spending has never been so slack and only once before has job growth been slower, according to an Associated Press analysis this month.

A report released Tuesday showed the U.S. economy grew at a 1.7 percent annual rate from April to June ? an upward revision from the initial 1.5 percent estimate but still signaling continued sluggishness.

Gasoline prices have been rising again toward $4 a gallon. Concerns remain over debt problems in Europe and a slowdown in China. And despite improving U.S. job and housing markets, consumer confidence is at its lowest level since November 2011.

Nigel Gault, chief U.S. economist at IHS Global Insight, said "housing is the area where you've got the most positives," and that's extremely important since housing weaknesses were a central cause of the downturn.

"We are at the start of a long prolonged recovery in the housing market. We're not bouncing along the bottom anymore," Gault said. "But there's still a long list of other reasons for businesses and consumers to be cautious."

"There's not much to gloat about," said Robert Shapiro, a former undersecretary of commerce in the Clinton administration who now advises Democrats and runs an economic consulting firm.

But things aren't as bad as Republicans portray, he said. "There is a recovery. We've been in a recovery in fact for over two years. It's an unusually slow recovery but it is a recovery."

Shapiro said Obama "can be justly proud of putting in place policies that stopped the slide into depression."

Some Republicans boast of improvements in their own states even as they recite a litany of national woes.

Ohio Gov. John Kasich touted a gain of 100,000 jobs in his state in the last year and an unemployment rate below the national average. Virginia Gov. Robert McDonnell told fellow Republicans that over the last two years, "with Republicans and Democrats working together, our unemployment rate is down over 20 percent."

McDonnell, who is also chairman of the Republican Governors Association, asserted that Republican governors generally do a better job handling economic challenges than their Democratic counterparts.

But since 29 of the 50 states have Republican governors, you'd think this would show up on the national charts. It doesn't.

"Mitt Romney will tell us the hard truths we need to hear to end the torrent of debt that is compromising our future and burying our economy," said New Jersey Gov. Chris Christie, the convention's keynote speaker. Unemployment in New Jersey is 9.8 percent ? among the nation's highest.

"You can't believe anything you hear at a political convention. It's all a marketing opportunity," said economist Bruce Bartlett, an economic adviser to Presidents Ronald Reagan and George H.W. Bush, both Republican.

"Some sectors of the economy are showing signs of life, others are showing weakness. I can't blame Republicans for focusing on the ones showing weakness. As polls clearly show, the economy is clearly Obama's biggest weakness."

National polls show the economy remains the top issue by a long shot, including an AP-GfK poll taken a week before the GOP convention that showed 60 percent of those surveyed believe the country is headed in the "wrong direction," compared to only 35 percent who chose "right direction."

Most Popular Desktop Music Player: iTunes Picking the best desktop music player is no easy task. What makes for the best in one user's mind is different than another's, mostly because feature-sets differ so much. Still, whether you need a music store attached to your player, a complete song tagging and organization engine, syncing with mobile devices, or just a fast and lightweight player, you weighed in with dozens of nominations when we asked you which player is the best. Then, we took a look at the top five desktop music players. Now we're back to crown the winner, by your vote.

Most Popular Desktop Music Player: iTunes Love it or hate it (and most of you fall squarely in either camp: either you love iTunes' simplicity and features, or you hate it with the fury of a thousand suns), but iTunes took the top spot in the poll with just under 30% of the overall vote, winning by a mere 156 votes.

Hot on its heels in second with just under 29% of the votes cast was Winamp, still whipping the llama's ass after all these years. In third, right behind Winamp, was the fast and infinitely flexible foobar2000, bringing in close to 24% of the overall vote. Mahindra's compact SUV 'Quanto' to be launched in second half of ...

India's largest utility vehicle maker, Mahindra & Mahindra has christened its compact sports utility vehicle (SUV) as 'Quanto', which will hit the market in the second half of September 2012. At a sub-4 meter length, the?Quanto?will be the smallest?SUV?in Mahindra's product portfolio, which is aimed at the buyers of diesel hatchback and entry level sedan customers.

Based on the 'Ingenio' platform, Quanto will be a sub-4 metre SUV, which will be powered by 1.5 litre diesel engine, thereby it will enjoy the excise duty of small cars. While, M&M has not revealed the prices yet, the SUV is likely to be priced between Rs 4.5-5.5 lakh. The launch comes at a time, when a lot of car buyers are graduating from small car to SUVs instead of sedans and the Quanto will also try to win away some of the prospective hatchback customers.

Israel's solar power struggles against government

KVUTZAT YAVNE, Israel (AP) ? Israel has developed some of the world's most advanced solar energy equipment and enjoys a nearly endless supply of sunshine, but when it comes to deploying large-scale solar technology at home, the country remains in the dark ages.

Solar power provides just a tiny percentage of Israel's energy needs, leaving it far behind colder, cloudier counterparts in Europe. Israeli solar companies, frustrated by government bureaucracy, have taken their expertise abroad.

Fifty years ago, Israel was at the front of the pack, with simple solar water heaters on top of its apartment buildings. They're still there, but little else has moved forward.

Advanced solar power has come to the tiny community of Kvutzat Yavneh, but its small scale is more an example of what can be done than what has been done.

Nestled in grape vines and pomegranate trees in south-central Israel, the 16 glimmering installations, each of them four meters (14 feet) tall, are an odd sight in this traditional collective farm, which also features a pickling factory and a barn.

The solar panels provide the community with nearly all of its hot water, and the electricity they generate is sold to Israel's main energy provider, the Israel Electric Corp.

Miriam Schlusselberg, a secretary at the kibbutz, said the 320 residents are "very excited" to get solar power in their backyard. But she also acknowledged that solar energy on a large scale "is not going to develop on its own unless people start investing in it."

The field in Kvutzat Yavne, built by the Israeli company ZenithSolar Ltd. in 2009, has a maximum capacity of about a quarter of a megawatt of combined thermal and electric power. That's not even a dent in Israel's overall capacity of some 12,000 megawatts.

"This is, unfortunately for us, our only project in Israel," said Roy Segev, co-founder of ZenithSolar. "I think there was a poor policy from the Israeli government. It was a total neglect of the possibility to create a big industry in Israel."

Segev said there has not been enough government investment in solar manufacturing or startup companies. He pointed out that industry leaders such as Germany and Italy have outpaced Israel in solar development, despite having fewer sunny days and less powerful sunrays. The Germans, for instance, generate nearly 12 times as much solar power per capita as their Israeli counterparts, according to official statistics from both countries.

Israel has a solar capacity ? the amount of energy it could continuously generate in ideal conditions ? of 212 megawatts, most of which comes from rooftop installations, according to the electric company. That accounts for less than 2 percent of the nationwide capacity and falls well short of the country's 2014 goal of 1,480 megawatts from solar sources.

As a result, "no one in the international community is going to take Israel seriously going forward," said Jon Cohen, CEO of the Arava Power Co. "The natural resource exists, the real national need exist ? it's really a mystery why (solar) is being blocked."

Cohen spearheaded Israel's first major commercial solar project, the Ketura Sun plant. The 5-megawatt facility is in the Negev desert, an arid, sparsely populated wedge of land that makes up the southern two-thirds of Israel. The area enjoys around 330 sunny days a year, making it an ideal site for solar power.

But no more large-scale projects have launched since Ketura Sun began operating in June 2011.

"We thought we'd be raising the pioneer flag," Cohen said, pointing out that his company fought for four years to get the necessary approvals and permits for the field. "We were hoping we'd have more to show on the ground promptly, and here we are a year later, and we haven't gone far."

There are some signs of change.

In March, Ashalim Sun PV, a U.S.-Israeli consortium, won a government tender to construct three major solar power plants in the Negev that will provide a combined 250 megawatts of power. The plant is not expected to open until 2015 at the earliest.

Cohen has 10 projects in the works that envisage producing a total of 100 megawatts when completed. Three are still awaiting government approval, a situation he described as "tense and endless."

Smadar Bat-Adam, chief of staff for Israel's Energy and Water Resources Ministry, acknowledged that red tape has been an issue. "We are trying to solve the bureaucratic problems," she said.

Bat-Adam said the overambitious 2014 target was set several years ago, before Israel had substantial solar infrastructure or regulation. While that may not be reached, she said Israel is on track to reach its 2020 benchmark of generating 10 percent of its electricity needs from renewable sources.

"When it comes to infrastructure projects, it always takes time," she said.

Currently Israel gets most of its power from burning imported fossil fuels, but there is interest in developing alternative sources such as wind and solar. Israel is also rapidly developing natural gas reserves off its Mediterranean coast.

Recognizing solar power's potential, the Israeli government set up a "feed-in tariff" incentive in 2008, agreeing to pay developers higher-than-retail prices for solar energy fed back into the grid.

Because the government does not want to overpay, it has repeatedly adjusted the tariff as solar equipment has gotten cheaper. As a result, many large projects are on hold, awaiting a firm price.

Many analysts and industry professionals believe this uncertainty has hindered investment.

"The sad reality is that we've raised quite a lot from Israeli investors, and we are taking this money and investing it overseas because the industries are more consistent," said Nimrod Goor, a founding managing partner at Helios Energy Investments LP, an Israel-based infrastructure equity fund.

The situation has made some experts skeptical of Israel's commitment to harvesting its ample sunlight.

Uri Marinov, an environmental management professor at the Inter-Disciplinary Center in Herzliya and a former director of the Israeli Environment Ministry, said decision makers are making "big, big mistakes" through unnecessary regulations.

"Anyone who wants to build a solar field should be able to do it," he said.

Israel is still a leader in solar research and development. Segev teamed up with the Ben-Gurion University of the Negev to produce a little household system that reflects concentrated sunlight onto a receiver, producing electricity with roughly two times the efficiency of standard panels. Segev hopes the new model, named the Z10, will find a market in homes throughout Israel.

One of the Z10's advantages? "It doesn't need any government support or intervention to set it up," Segev said.

With centres in London, Leeds and Hereford, The Haven is the only national breast cancer charity that provides one-to-one support to improve the quality of life of anyone affected by breast cancer.

The Haven?s programme of care costs around ?1,000 to deliver to each visitor and the charity relies on donations of individuals and organisations to deliver its services. Since opening in 2004, The Hereford Haven has arranged more than 23,000 appointments and helped almost 2,000 visitors.
ROBOCAP is a charity aimed at providing ?Robotics Assisted Surgery? for men suffering from prostate cancer in the three shires of Gloucestershire, Herefordshire and South Worcestershire. In excess of 800 men a year are diagnosed with prostate cancer in the three shires.

Mr Lamond appealed to the people of Hereford and surrounding area to turn out to support the fundraising event for such good causes.

NY gunman quiet loner, victim outgoing family man

NEW YORK (AP) ? A gunman who killed a former co-worker in cold blood in the shadow of the Empire State Building and then was shot dead by police after he turned his gun on them spent long hours in the quiet of Central Park, photographing hawks and marveling over nature's beauty.

His victim was a gregarious salesman, beloved by his nieces and nephews as the fun uncle who could talk with equal expertise about the New York Jets and the women's fashion accessories he sold.

Investigators on Saturday were trying to piece together what caused Jeffrey Johnson, a T-shirt designer, to ambush Steve Ercolino, an apparel company vice president, a day earlier outside the Manhattan offices of the company where they once were colleagues.

Police said Johnson hid behind a car and then killed Ercolino with five gunshots as he arrived for work. Johnson then was shot by two police officers who confronted him on a busy sidewalk.

Security camera footage showed the officers had only an instant to react when Johnson suddenly turned as they approached and pointed his gun at them, his arm cocked as if to fire.

Their encounter was over in eight seconds. The officers, who had been standing nearly close enough to shake hands with Johnson and had no opportunity to take cover, fired almost immediately.

Nine bystanders were wounded in the 16-shot volley, likely by stray or ricocheting police bullets. None of their injuries was life-threatening, police said.

Police investigating Johnson's killing of Ercolino were eyeing bad blood between them from when they worked together at Hazan Import, a garment district business where Ercolino was a vice president of sales.

Johnson and Ercolino had traded harassment accusations when they worked together, police said, and when Johnson was laid off from the company a year ago he blamed Ercolino, saying he hadn't aggressively marketed his new T-shirt line.

After Johnson's layoff, neighbors said, he continued to leave his apartment every day in a suit.

Internet records listed Johnson as the administrator of the website for a business called St. Jolly's Art, which sold iron-on graphic art for T-shirts. Art for sale on the site included stylized drawings of fighter planes and muscle cars and whimsical "seafaring vignettes" featuring pirate maidens and tall ships.

Johnson also was part of a community of bird watchers and photographers who document hawks and other wildlife living in Central Park, a few blocks from his home.

In one email to another bird watcher who works at The Associated Press, Johnson wrote tenderly about spending a winter night watching ducks in the park.

"Near midnight by the Harlem Meer I watched a little 'flotilla' of Mallards swimming and softly honking ... fifteen degree temp and they were carrying on unfazed. Just remarkable," he wrote.

His photographs of Central Park's hawk population appeared regularly on blogs tracking the birds.

A neighbor who often saw Johnson, 58, said he was always alone.

"I always felt bad," said Gisela Casella, who lived a few floors above Johnson in a modest apartment building on the Upper East Side. "I said, 'Doesn't he have a girlfriend?' I never saw him with anybody."

Ercolino, 41, was described by his relatives as the opposite of a quiet loner.

His eldest brother, Paul Ercolino, said he was a gregarious salesman who often traveled, had a loving girlfriend and was the life of any family gathering.

"He was in the prime of his life," he said. "He would do anything for anybody at any time. ... He was so wonderful with my children. At Christmastime, he was the one who always had the best presents for the kids."

Paul Ercolino said his brother, known to nieces and nephews as Uncle Ducky because of his nearly blond hair, had followed his father into the garment industry after growing up in Nanuet, just north of New York City, then later worked in women's handbags and accessories. He said his brother had never mentioned to the family that he had any problems with a co-worker.

Hazan Import Corp. executives didn't return phone calls seeking comment Friday.

Johnson, after waiting for Steve Ercolino to come to work, walked up to him, pulled out a .45-caliber pistol and fired at his head, police Commissioner Ray Kelly said. After Ercolino fell to the ground, Johnson stood over him and shot four more times, a witness told investigators.

"Jeffrey just came from behind two cars, pulled out his gun, put it up to Steve's head and shot him," said Carol Timan, whose daughter, Irene Timan, was walking to Hazan Imports at the time with Ercolino.

In security camera footage released by the police, Johnson can be seen walking calmly down the sidewalk after the shooting, distancing himself slightly from the other pedestrians, who appear to have no awareness that anything is wrong.

But when two police officers approach in a hurry, Johnson turns and pulls a handgun from a bag. Then, the scene explodes into action. People seated on a bench behind the gunman and pedestrians standing close to the two officers run for their lives.

Only a young child seems not to react, strolling out of view of the camera as adults all around leap away in terror.

Startled New Yorkers later looked up from their morning routines in the crowded business district to see people sprawled in the streets bleeding and a tarp covering a body in front of the tourist landmark.

"I was on the bus, and people were yelling 'Get down! Get down!" accountant Marc Engel said. "I was thinking, 'You people are crazy. No one is shooting in the middle of midtown Manhattan at 9 o'clock in the morning.'"

It was over in seconds, he said ? "a lot of pop, pop, pop, pop, one shot after the other."

Afterward, he saw sidewalks littered with the wounded, including one man "dripping enough blood to leave a stream."

The officers who fired were part a detail regularly assigned to patrol landmarks such as the 1,454-foot-tall skyscraper since the Sept. 11 terror attacks, officials said.

Kelly, the police commissioner, said the officers who confronted Johnson had "a gun right in their face" and "responded quickly, and they responded appropriately."

"These officers, having looked at the tape myself, had absolutely no choice," he said.

A witness had told police that Johnson fired at the officers, but authorities say ballistics evidence doesn't support that. Johnson's gun held seven rounds, they said. He fired five times at Ercolino, one round was still in the gun and one was ejected when officers secured it, authorities said.

A loaded magazine was found in Johnson's briefcase.

Johnson legally bought the gun in Sarasota, Fla., in 1991, but he didn't have a permit to possess it in New York City, authorities said.

Mayor Michael Bloomberg said New York still is the safest big city in the country, on pace to have a record low number of murders this year.

"But we are not immune to the national problem of gun violence," he said of the shooting, following mass shootings at a Colorado movie theater and a Sikh temple in Wisconsin.

The nine people wounded outside the Empire State Building were all from New York City, except for a woman from Chapel Hill, N.C. They suffered graze wounds or other minor injuries.

Metal detectors and bag searchers have been standard at the Empire State Building since 1997, when a gunman opened fire on the 86th-floor observation deck, killing one tourist and wounding six others before fatally shooting himself.

The skyscraper remained open Friday throughout the mayhem, although its workers became witnesses.

"We were just working here and we just heard bang, bang, bang!" said Mohammed Bachchu, a worker at a nearby souvenir shop.

He said he rushed from the building and saw seven people lying on the ground, covered in blood.

Rebecca Fox said she saw people running down the street and initially thought it was a celebrity sighting, but then she saw a woman shot in the foot and a man dead on the ground.

"I was scared and shocked and literally shaking," she said. "It was like 'CSI,' but it was real."
